Here's a high-level overview of how an SDIRA investor's rollover got whacked. And not just any SDIRA investor - James Caan of Godfather fame.Just wrote a fairly lengthy blog post about a recent Tax Court ruling important for SDIRAs. Aside for what I think most of the focus will be drawn to, the ruling is instructive regarding more careful structuring of properly done trustee-to-trustee in-kind rollovers.James Caan contended that he had accurately rolled over an LP interest from his IRA at UBS to an IRA at Merrill Lynch. However, UBS had previously resigned as custodian and issued a 1099-R for the in-kind distribution of the asset. Ultimately, the hedge fund interest was liquidated, and the cash proceeds were transferred to Merrill Lynch—nearly a year after UBS reported the fund’s distribution to Mr. Caan.The IRS determined that the rollover was invalid and assessed substantial taxes and penalties. In a notice of deficiency dated April 30, 2018, the IRS determined an income tax deficiency of $779,915 for tax year 2015 and a section 6662(a) accuracy-related penalty of $155,983. Mr. Caan petitioned the Tax Court, which sided the IRS and sustained the IRS' assessments (aside for a reduction due to adjustment to the valuation of distributed asset).Here's a link to SDIRA Rollover Gets Whacked: Estate of James E.
